Booking Conditions
THE FRENCH VERSION IS THE ONE THAT HAS LEGAL VALUE
1. Conclusion of Contract
With the verbal or written registration (i.e. booking of clients) made by Valais-Wallis Adventures Sàrl By booking with the company, registration number CHE 339.751.024, or one of its booking agencies (hereinafter referred to as "the organiser"), a contract is automatically established between the customer and the organiser. By making a reservation, the customer acknowledges the general terms and conditions of the company as part of the contract between him/her and the organiser.
2. Purpose of the agreement
The organiser assumes responsibility for and undertakes to provide the required service as described in the advertisement and/or in the order confirmation. Extensions of services can be agreed with the organiser. Any costs associated with an extension of service will be borne by the customer.
3. Awards
The actual prices for the activities offered are identical to those mentioned in the advertisements issued by the organiser. The prices in the brochures are per person, in Swiss Francs, including VAT. Prices are subject to change.
4. Booking and payment conditions
The activity must be paid in full when booking online or by invoice. If you send an invoice by email, the reservation is valid for 3 working days. Payment must be made within this period, after which time the booking will be cancelled.
In the event of a participant's withdrawal or cancellation, the procedures are described in point 5.
5. Cancellation or modification of the contract by the client
Cancellations must be made by email to info@valaiswallisadventures.ch or by written notice to Valais Wallis Adventures Sàrl, route de Fontenelle 63, 1976 Erde. Cancellations are only valid after consultation with and agreement of the organiser. All documents received (confirmation, tickets, coupons, etc.) must be returned to the organiser.
In the event of a total cancellation, the following costs will be charged to the customer:
- More than 7 days: full refund of the activity.
- 7-3 days before the start of the activity: 50% of the total amount.
- Less than 3 days before the start of the activity or if the clients do not show up: 100% of the amount.
In the event of a partial cancellation of a group booking (reduction in the number of participants) the following charges will be levied
- 7-3 days before the start of the activity: 30% of the amount per withdrawal.
- less than 3 days before the activity: 100% of the amount per withdrawal.
If the date of the activity is changed 3 days before or on the day of the activity, a processing fee of CHF 40 per person will be charged. If due to late arrival the client cannot participate in the activity, or if for the same reason the activity has to be cancelled: 100% of the total price will be charged to the client. If due to late arrival only a limited number of people participate, no refund will be made.
6. Withdrawal of the organiser
Minimum number of participants
For all our activities a minimum number of participants is required. If the minimum number is not reached, the organiser can cancel the activity up to one day before the start of the activity without compensation.
Cancellation before the start of the activity
The organiser may cancel the activity, if the participant gives reason to believe that he/she is not fit to participate in the activity (alcohol, drugs, physical or psychological disability). In this case, the cancellation conditions according to clause number 5 are valid. If the weather or nature, official measures, natural disasters, security reasons or other factors hinder or threaten the safety of the activity, the organiser may cancel it. The amounts paid will be refunded in full by the organiser.
7. Conditions of participation, obligations of the participant
Good health is required to participate in the activities. Participants are obliged to inform the organiser of any health problems. Under no circumstances may a participant take part in an activity while under the influence of alcohol, medication, drugs or any other substance that impairs his/her physical or mental abilities. Participants are obliged to complete the participation conditions and must strictly follow all instructions of the organiser, trip leader, guides and assistants. If the conditions of participation are not fulfilled or the instructions neglected, the organiser reserves the right to forbid the client to participate. The organiser accepts no responsibility for any accidents that may occur as a result of the guides' failure to follow the safety instructions. The organiser accepts no responsibility for the loss or theft of equipment. The organiser also declines all responsibility if personal equipment taken by the client on a boat is lost.
8. Insurance
Participants must have valid accident insurance for the chosen activity.
9. Disputes
If any complaints are made by the client during the activity, they must be communicated immediately orally to the trip leader and in writing to the organiser. The trip leader is not obliged to acknowledge a complaint, so all complaints must be forwarded to the organiser in writing. The organiser will make every effort to remedy the situation. If a solution is not found immediately, the complaint must be sent in writing to the organiser or the booking agency within four weeks (date of postmark) of the contractual end of the activity. The customer's complaint must be accompanied by the confirmation of participation in the activity and be substantiated in order to justify the complaint. In the case of complaints sent late to the organiser or related to the failure of the guides to follow instructions during the activity, they will be considered null and void. Complaints against the organiser for damages are excluded, as long as the damage was not caused by negligence or intention. The organizer can send customers to a partner activity provider. If the organiser transfers the execution of the activity to a third party, the organiser cannot be held responsible for the actions or negligence of the third party during the execution of the activity.
10. Applicable law and place of jurisdiction
Swiss law, excluding international agreements, is exclusively applicable to the contractual relationship.
The exclusive place of jurisdiction for all disputes arising directly or indirectly from this contract shall be CH-1964 Conthey.
Booking Conditions Applicable from 01.11.2016
If one or more clauses of the company's general terms and conditions are inapplicable and/or incomplete, the clause that comes closest to the law shall replace the inapplicable and/or incomplete clause. The inapplicability and/or incompleteness of a clause does not affect the effectiveness of the other clauses.
